Responsibilities include claim intake and evaluation, where the vendor will review referred claims to assess subrogation viability, analyze liability and damages, examine insurance coverage, and determine collectability. Evaluation must also account for statutory deadlines, and vendors should provide actionable recommendations for recovery strategies.
The scope of work encompasses detailed investigation to identify responsible parties and insurance carriers. This includes gathering pertinent documents such as police reports, repair estimates, photographs, insurance data, online searches, and witness statements as needed. Close coordination with agency staff is required to obtain any necessary supplemental documentation.
Vendors are expected to manage the demand and negotiation process, preparing and issuing demand packages, conducting negotiations with adverse parties and insurers, and maintaining thorough records of all communications, offers, and settlement discussions. Support for arbitration and, where authorized by the agency, litigation is also required. Any anticipated litigation-related costs must be communicated in advance, and prior agency approval is mandatory before litigation is pursued. The initial contract period will be for one year.
