Provide samples as required, labeled correctly, and delivered by the closing date and time.
Provide a Certificate of Insurance before contract award.
Adhere to the University's Smoke-and-Tobacco-Free Campus policy.
Complete background checks for staff and subcontractors who may be on site at the University.
Provide audited financial statements for the past three years upon request.
Provide a customer reference list of at least three organizations similar in size and scope.
Comply with University's terms and conditions or propose redlined changes in an editable Word document.
Certify examination of all instructions, requirements, specifications, terms, and conditions of this RFP.
Certify possession of necessary experience, knowledge, abilities, skills, capacity, resources, financial ability, willingness, and business integrity.
Certify compliance with all applicable federal, state, and local laws, rules, regulations, and ordinances, and confirm not being debarred or suspended.
Certify that all statements, information, and representations in the proposal are current, complete, true, and accurate.
Agree that submitted materials are non-confidential unless strict procedures for trade secret designation are followed.
Agree to defend and settle any action seeking release of materials believed to be trade secret.
Certify proposal submission at own risk and expense, and waive claims related to the RFP or award process.
Certify proposal is a valid, firm, and irrevocable offer for 180 days from the due date.
Certify authority to bind the organization and agreement to all certifications.
If participating in the Targeted Group Business (TGB) Program, complete the 'Supplier Diversity Commitment' questionnaire in the SmartCOMP tool.
If participating in the TGB Program, agree to fulfill commitments and submit monthly reports.
Comply with Payment Card Industry Data Security Standards (PCI DSS) if accessing credit/debit card information or affecting transaction security.
Comply with the Copeland 'Anti-Kickback' Act and related regulations if for building construction or repair of $2,000 or more.
Comply with the Davis-Bacon Act and related regulations if for building construction or repair of $2,000 or more.
Comply with the Contract Work Hours and Safety Standards Act and related regulations if for building construction or repair of $2,500 or more.
Pay prevailing wage rates on project work site if for building construction or repair of $2,500 or more.
Comply with the Byrd Anti-Lobbying Amendment if the agreement is in excess of $100,000.
Comply with Affirmative Action, Equal Employment Opportunity, and Targeted Group Business policies.
Adhere to federal flow-down requirements if federal funds are used for procurement.
Assign to the University all claims for overcharges resulting from antitrust violations.
Notify the University if furnishing export-controlled items.
Place the University Purchase Order Number on all packages, invoices, packing slips, notices, and correspondence.
Comply with Prohibited Telecommunications and Video Surveillance Equipment and Services as per the 2019 National Defense Authorization Act.
