Clear vinyl must meet specific technical specifications including 10.5 oz minimum, double coated, PVC film, 1000D x 1000D polyester reinforcement, 16 mil thickness, 22#/2" adhesion, warp 170#/fill 150# breaking strength, warp 100#/fill 90# tear resistance, flame retardancy (16 CFR Part 1633 or 1632), antimicrobial finishes (parallel streak method, AATCC 147 active standard), and 200 minimum hydrostatic resistance (ASTM D751)
Rolls of fabric must be 32 inches wide, 100 yards per roll, with a maximum of one splice per roll (splice piece not smaller than 25 yards)
Rolls shall have a 2 to 3 inch core and be received on pallets
Bidder must certify eligibility regarding suspension, debarment, and terrorism (compliance with Executive Order 13224 and SAM.gov)
Bidder agrees that any payments will be applied towards debts owed to the State of Texas
Contract and related information are subject to the Texas Public Information Act (Chapter 552, Government Code)
Vendor agrees not to use Artificial Intelligence in contract performance without prior written consent of TDCJ
Compliance with TDCJ security procedures for deliveries to correctional facilities is required, including security escorts, no inmate interaction, adherence to PD-29, staff/vehicle searches, locked vehicles, no contraband, appropriate attire, and restrictions on ex-inmates, minors, and pets
Bids must comply with all Texas purchasing rules, regulations, and statutes
Bid prices must be firm for 30 days from bid opening date
Bidder must provide Texas Identification Number System (T.I.N.S.) number and Federal Employer's Identification Number (EIN)
Bids cannot be altered after the opening time
Bids must not include State Sales tax and Federal Excise tax
Items must be new, unused, and of current production
Bidder must indemnify the State for acts/omissions and intellectual property infringements
Bidder must certify no economic opportunity, gift, or favor has been given to a public servant in connection with the bid
Bidder must certify no violation of antitrust laws or communication with competitors
Bidder must certify no compensation was received for preparing the solicitation specifications
Bidder must certify eligibility regarding child support obligations and provide names and Social Security Numbers for owners with 25% or more interest
Bidder must certify no conviction for violating federal law or penalty related to disaster relief
Bidder must certify compliance with Section 669.003 of the Government Code regarding contracting with executive heads of State agencies
Bidder agrees to purchase Texas-produced products/materials when available at comparable price and time
Bidder must certify no lobbying activities are prohibited by Sections 556.005 or 556.008 of the Government Code
Bidder must certify no actual or potential conflicts of interest
Bidder must certify compliance with Section 572.069 of the Government Code regarding employment of former state officers or employees
Bidder must certify compliance with Chapter 2271 of the Government Code regarding not boycotting Israel
Bidder must certify compliance with Chapter 2252.152 of the Government Code regarding not doing business with Iran, Sudan, or foreign terrorist organizations
Bidder must certify compliance with Chapter 2275 of the Government Code regarding not contracting with certain foreign-owned companies in critical infrastructure
Bidder must certify no COVID-19 vaccination or post-transmission recovery requirement for customers
Bidder must certify not majority owned/controlled by or headquartered in certain countries (China, Iran, North Korea, Russia)
Bidder must certify no boycott of energy companies
Bidder must certify no discrimination against firearm entities or trade associations
The contract is subject to audit or investigation by the State Auditor
